[Important] Beware of Visa Renewal "Denial" Risk Due to Regional Minimum Wage Increases
September 30, 2026 was the final day under the old Immigration fee structure, with the new tiered fees taking effect from October 1. But fees aren't the only thing changing in October — the "Regional Minimum Wages" set by the Ministry of Health, Labour and Welfare are also being revised (increased), taking effect prefecture by prefecture between October 1 and December 2. An employment contract below the new minimum wage can create a visa-renewal denial risk — this article explains the key points for advising host companies.
September 30, 2026 was the final day under the old Immigration fee structure, and the new fee system took effect today, October 1. However, fees aren't the only thing changing in October — the "Regional Minimum Wages" set by the Ministry of Health, Labour and Welfare are also being revised (increased), taking effect prefecture by prefecture between October 1 and December 2, 2026. This is a major pitfall in work-visa renewal practice.
Key Practical Points
- The effective date differs by prefecture — it is NOT nationwide at once: only 15 prefectures (Hokkaido, Miyagi, Tochigi, Saitama, Chiba, Tokyo, Kanagawa, Niigata, Toyama, Gifu, Aichi, Mie, Osaka, Hyogo, and Kagawa) take effect on October 1, 2026. The remaining 32 prefectures take effect at various dates from mid-October through December 2. Check the effective date for the host company's location (by office) first.
- An employment contract below the "new minimum wage" risks visa denial: for work visas such as Specified Skilled Worker, Technical Intern Training, and Engineer/Specialist in Humanities/International Services, it is a strict requirement that remuneration be "equal to or greater than that of a Japanese national doing the same work" and that the employer "complies with the Minimum Wage Act." If the basic salary in the employment contract or payroll submitted for renewal falls below the new minimum wage once it takes effect, the application may require additional explanation, a salary correction, or be denied.
- Beware of the "hourly-rate conversion" trap: even for salaried employees, the basic salary (excluding overtime, commuting allowances, etc.) divided by the average scheduled monthly working hours must exceed the new minimum hourly wage. Every year, some employers overlook this and submit renewals with the old salary figures.
- Action for supporters: advise the host companies you support to first check the effective date for their location, then recalculate their foreign employees' salaries (especially the base pay of salaried staff) to confirm they clear the new minimum wage. If a salary adjustment is needed, it must apply from the pay period in the month the new wage takes effect.
